Emulex Statement on “Conflict Metals”

Emulex shares the worldwide concern regarding allegations that profits from illegal metals mining in the Eastern Region of the Democratic Republic of the Congo (DRC) may be fueling human rights atrocities, and that these illegally mined materials may be making their way into the electronics supply chain.

For the past several years, industry groups, including Electronics Industry Citizenship Coalition (EICC), the Global eSustainability Initiative (GeSI), the International Tin Research Institute (ITRI) Tin Supply Chain Initiative (iTSCi) and the IPC Solder Product Value Council (SPVC), have been working to provide transparency and accountability concerning the supply of raw materials coming from the conflict zones of the DRC.  Emulex fully supports these efforts and the 2009 EICC Agreement “that mineral extraction and transport activities that fuel conflict are unacceptable”

Emulex is in full compliance with the 2010 Dodd-Frank Wall Street Reform and Consumer Protection Act (Wall Street Reform Act) which requires annual disclosure to the SEC whether products contain conflict metals sourced from the Democratic Republic of the Congo (DRC) or adjoining countries. Public companies are required to submit a due diligence plan with the company’s annual SEC report that includes:

a.  A description of the measures taken by the company to prevent sourcing from the Congo;
b.  A description of the products manufactured or contracted to be manufactured that are not conflict free, the facilities used to process the conflict minerals, the country of origin of the conflict minerals, and the efforts to determine the mine or location of origin;
c.  An independent third party audit of the company’s due diligence plan; and
d.  A certification by the company of its due diligence report.

Emulex expects our suppliers to comply with the EICC and ensure that parts and products supplied to Emulex are DRC conflict-free (do not contain metals derived from “conflict minerals”; columbite-tantalite (tantalum), cassiterite (tin), gold, wolframite (tungsten), or their derivatives such that they do not directly or indirectly finance or benefit armed groups through mining or mineral trading in the DRC or an adjoining country). Suppliers are to establish policies, due diligence frameworks, and management systems, consistent with the OECD Due Diligence Guidance for Responsible Supply Chains of Minerals from Conflict-Affected and High-Risk Areas, that are designed to accomplish this goal.
